These Terms of Service (“Terms”) govern your access to and use of the VPS hosting, cloud server, virtual private server, networking, storage, billing, and support services provided by TechVPS (“TechVPS”, “we”, “our”, or “us”).

By creating an account, placing an order, paying an invoice, using a VPS instance, or accessing our website at https://techvps.website, you agree to these Terms, our Privacy Policy, Refund Policy, Cookie Policy, Acceptable Use Policy, and DMCA Policy.

2. Service Eligibility

You may use TechVPS services only if you are legally able to enter into a binding agreement and if your use complies with all applicable laws and regulations.

By using our services, you confirm that:

  • You provide accurate account, billing, and contact information.
  • You are responsible for all activity under your account.
  • You will not use TechVPS services for illegal, abusive, harmful, or fraudulent activities.
  • You will follow our Acceptable Use Policy.

3. Account Registration and Security

Customers are responsible for maintaining the security of their account, client area, VPS credentials, SSH keys, passwords, API keys, and billing information.

You agree to:

  • Use accurate registration and billing details.
  • Keep your login credentials confidential.
  • Use strong passwords and security best practices.
  • Notify TechVPS immediately if your account, VPS, or credentials are compromised.

TechVPS is not responsible for damage, data loss, abuse, or service misuse caused by weak passwords, leaked credentials, compromised scripts, outdated software, or unauthorized access to your account.

4. VPS Provisioning and Service Delivery

TechVPS services are delivered digitally. After successful payment and fraud/security review, VPS services are typically provisioned automatically or manually within a reasonable timeframe.

Service activation may be delayed if:

  • Payment requires additional verification.
  • The order appears high-risk or suspicious.
  • The selected VPS plan, IP address, or location is temporarily unavailable.
  • Additional compliance or abuse checks are required.

We reserve the right to refuse, cancel, or review any order that appears fraudulent, abusive, incomplete, or inconsistent with our policies.

5. Customer Responsibility

Unless otherwise stated, TechVPS VPS services are unmanaged. This means customers are responsible for configuring, securing, updating, monitoring, and maintaining their own server environment.

You are responsible for:

  • Installing and updating operating systems, software, panels, scripts, and applications.
  • Securing SSH, RDP, firewall, database, web server, and admin panel access.
  • Maintaining backups of your data.
  • Monitoring CPU, RAM, disk, bandwidth, email, and network usage.
  • Ensuring your hosted content and server activity comply with applicable law.
  • Preventing spam, malware, phishing, scanning, proxy abuse, DDoS activity, copyright infringement, or other prohibited usage.

6. Billing and Payments

TechVPS services are provided on a prepaid basis. Customers must pay all invoices before services are activated, renewed, or continued.

Payments may be processed through available payment methods shown at checkout, including supported payment gateways, cards, PayPal, or other listed payment options.

You agree that:

  • Prices are shown before checkout.
  • Services renew based on the selected billing cycle.
  • Unpaid invoices may result in service suspension.
  • Continued non-payment may result in service termination and data deletion.
  • You are responsible for maintaining a valid payment method for recurring services.

7. Suspension and Termination

TechVPS may suspend, restrict, or terminate services if:

  • Invoices remain unpaid.
  • The account violates these Terms or the Acceptable Use Policy.
  • The VPS is involved in spam, phishing, malware, DDoS, copyright abuse, fraud, or illegal activity.
  • The customer provides false, incomplete, or misleading information.
  • The service causes harm to TechVPS infrastructure, network reputation, IP ranges, upstream providers, or other customers.

In serious abuse cases, TechVPS may suspend or terminate services without prior notice to protect the network, customers, IP reputation, and legal compliance.

8. Backups and Data Loss

Customers are solely responsible for maintaining independent backups of their data. TechVPS may provide backup options where available, but no backup system is guaranteed unless expressly stated in a written service agreement.

TechVPS is not liable for data loss caused by:

  • Customer error.
  • Software misconfiguration.
  • Compromised accounts.
  • Unpaid invoices.
  • Service termination.
  • AUP violations.
  • Hardware, network, or upstream provider incidents.
  • Force majeure events.

9. Network, Resource, and Fair Usage

TechVPS may monitor resource usage to maintain service quality, security, and network stability.

Customers must not use VPS services in a way that causes excessive load, network abuse, IP reputation damage, or disruption to other customers.

Activities that may be limited or reviewed include:

  • Abnormal CPU, RAM, disk I/O, or bandwidth consumption.
  • Mass scanning or brute-force traffic.
  • Email abuse or spam activity.
  • Public proxy, open relay, or traffic tunneling abuse.
  • DDoS participation or amplification.
  • Cryptocurrency mining that affects infrastructure stability.

10. Acceptable Use

Your use of TechVPS services must comply with our Acceptable Use Policy. The AUP forms part of these Terms.

Prohibited activities include, but are not limited to:

  • Malware, ransomware, botnets, phishing, fraud, or impersonation.
  • Spam, bulk unsolicited email, or open mail relays.
  • DDoS attacks, port scanning, brute forcing, credential stuffing, or hacking.
  • Hosting or distributing illegal, infringing, harmful, or abusive content.
  • Running services that intentionally hide, misrepresent, or facilitate illegal activity.

11. Refunds and Cancellations

Refunds are governed by our Refund Policy.

A refund request does not automatically cancel a service. Customers must cancel active services from the client dashboard or contact support.

Renewals, custom services, add-ons, used resources, suspended services, and accounts violating our policies may be non-refundable.

12. Intellectual Property

All TechVPS website content, brand names, graphics, text, layout, service descriptions, documentation, and platform materials are owned by TechVPS or licensed to TechVPS.

Customers retain ownership of content they upload or host on their VPS, but they are fully responsible for ensuring that such content does not violate copyright, trademark, privacy, cybersecurity, or other applicable laws.

13. Privacy

TechVPS handles personal data according to our Privacy Policy. By using our services, you agree that we may collect and process account, billing, security, technical, and support information as necessary to provide VPS hosting services.

14. Service Availability

TechVPS aims to provide reliable VPS hosting and cloud infrastructure services. However, services may be affected by maintenance, emergency repairs, upstream provider issues, routing incidents, datacenter outages, attacks, software failures, or events outside our control.

TechVPS does not guarantee uninterrupted or error-free service unless a separate written SLA is provided.

15. Limitation of Liability

To the maximum extent permitted by law, TechVPS is not liable for indirect, incidental, special, consequential, or business losses, including loss of revenue, profit, data, reputation, traffic, customers, or business opportunities.

Our total liability for any claim is limited to the amount paid by the customer for the affected service during the billing period in which the issue occurred.

16. Changes to These Terms

TechVPS may update these Terms from time to time to reflect changes in law, infrastructure, business operations, security requirements, or service features.

The updated version will be posted on this page with a revised effective date. Continued use of our services after changes are published means you accept the updated Terms.
